Call GM customer support. Next get a copy of that signed waiver and have it reviewed by an attorney. I would not let them off the hook for a dime until all options have been exhausted.

I would just get an attorney.

Yes, you signed a waiver, but there's still an expectation that the dealer will provide a reasonable amount of security. I believe you mentioned that this has happened multiple times in the past. If so, the dealer has failed to deliver a reasonable amount of security.

Thanks to all for all the positive thoughts and suggestions. I'm disappointed that my car was vandalized but what's really upsetting is the dealerships total lack of responsibility and the owners arrogant attitude. At this point I'm just looking to get some wheels so I can get my car out of their shop. I'm not one to sue anybody or slander anyone's business but I think the way it unfolded is justified. I just want my car back the way it was. I will post an update once I get my car out of there. Thanks again for all the support.

That might depend on your deductible. If its low then yes, probably making a profit. But if its $1000.00, Im not sure that the body shop would make alot of profit on a $6000.00 job after factoring out the deductible. Im willing to bet that he wants to have it done at his body shop to offset the cost to the dealership because of his profit (since apparently their insurance isnt paying for it for them.)

One thing you have to consider in your discussions with the dealer is the lost value due to the body work. It may not list as an accident in carfax, but many people can tell if body work has been done, even with an excellent shop. Make sure you keep the police reports and the paperwork on the repairs so you can explain why there was bodywork without an accident in case a future buyer asks.

Wow this truly sucks! Wish I knew about an extra set of wheels for you. We're these OEM rims and tires? Was the dealer north, south or mid-town? I definitely want to avoid. I hope you can find the dealer liable for lack of security.

Our insurance company insisted we include a waiver like this on all paperwork. BUT, we have never, and will never, actually hold anyone to it, it's not right. It's mostly so people can't claim previous damage happened while their vehicle was in our possession.

Our shop is in a pretty safe town, one street over from the police station but we still have cameras, inside and out. Thankfully never had to use them for more than figuring out where the hell I left my flashlight again.

Not sure in the US since i'm in Canada. Dealers here their deductibles are $5000.00

If that's the case that's probabably why the Dealer is trying to get out of it.

How is this not part of the insurance policy the dealer would have to carry?

If i rent something and it gets stolen, I'm on the hook for it. Otherwise who's to say I didn't steal it myself?

That's quite a racket they're trying to push. Dealer potentially stealing from customers who have their car there overnight. I could see them not being on the hook if a customer drops the car off off-hours but if it's in their care...on their lot, it's their responsibility. Especially in cases where they wont let you take the car back before they're waiting for a part or something and it's against franchise rules to give a non-repaired car back to a customer. I'd have never signed such a waiver because that just sounds utterly ridiculous. You wouldn't hire a contractor to work on your house or a mechanic to work on your car who wasn't insured in case they damage something while working. That's essentially what that waiver sounds like.

Well I borrowed a set of 5th gen wheels brought a jack and an electric impact to retrieve my car. I told the service advisor that I just wanted to get my car, I didn't want to speak to any management and especially the owners arrogant son Mike. The advisor said she wasn't sure if she could release the car, I told her I didn't want any confrontation and just wanted my car and I would change the wheels in the parking lot or out in the street.

After almost an hour she said to unload the wheels and her technicians would swap the wheels so I didn't damage theirs. I got the car home and put it on jackstands and returned the borrowed wheels.

I really think the owner should have stepped up and taken care of this instead of using my insurance. I'm not really upset about the damage to the car but am angry about the owners arrogant attitude. I told him I would just trade it in and order a new ZL-1 and his reply was we can do that but I have to deduct for the damage to your car and he kept talking about the damage to his fence. I think the only reason he offered to pay my deductible was he had a set of take off wheels that he was going to put on my car and pocket the difference.

If your in the Austin area and are considering using Don Hewlett Chevrolet I'd think twice before doing any business with them.
