Sorry to hear this....heartbreaking.
One thing that I do when I go to the dealer is to drop the car off close to the time that service closes. Then I insist that they leave the car in the in-bound express lane overnight.....

I would find out who the dealer's insurance company is and file a claim with them. Forget what the owner says and deal directly with the insurance company.

Sorry to read that...

The dealer donīt have an insurance to deal with? In EU is obligatory to have one, because if you let the car in his possession is him who is obliged to take care of it.

Garage Liability covers what your own insurance company doesn't. Your insurance is primary. If he covers your deductable move forward and get back on the road.

I had something similar years ago. Left my car overnight while the car was waiting for parts. Someone got into their back lot, took a knife to my convertible top to get in, got in the car & stole the stereo. Also pried open the trunk & took the subwoofer. Dealer made it right, apologized for the inconvenience, called the cops in to investigate, & I paid nothing without any prompting. And I signed the standard waiver just like everybody.

Good luck OP! I would get the local investigative news involved & talk with a lawyer. Their position may be "legal", but it isn't right. The court of public opinion could sway them if local TV guys expose them for being the ass that they sound like.

This is about doing the right thing. The dealer is not doing that. Like someone mentioned above it could be a scam the dealer is running.

Wow, this is terrible to read. I would definitely start writing some e-mails to corporate about this. The dealership should replace your wheels and damage. It's crazy they are going to hide behind a fine print waiver.

I am pretty sure if you let them take care of your deductable and have your insurance cover it, your insurance company will go after them or their insurance company to retrieve their money. Your insurance company has better lawyers than you can afford.

It's not a 'small print' waiver. It is a necessary tool for the business. If shops didn't have this everybody would claim everything in the world that is wrong with their cars.

Jacking it up like that is what my dealer did in error with their lift and it bent my front fender. What I noticed and they had to go back and fix was that the rocker panels were no longer flush with the bottom of the door. They ended up taking it back and replacing the rockers too. Double check the rocker alignment with the bottom of the door even if they match with the front and rear fender.

By what means are they securing the property? It matters not if you signed a waiver if they are negligent in securing the property. Also, contracts can be ambiguous and if they are, the party that wrote the contract cannot benefit from that ambiguity.

So, read the contract carefully, find out what they are doing to secure the property etc.

At a minimum take them to small claims court. If you can afford an attorney, have them take care of this.

Maybe your insurance company will do some of this on your behalf...IDK.

While this is an option, you may well find yourself with a claim against your driving record. This may cause your insurance rates to be much higher (you lose your good driver / no accident discounts, etc.)

I would suggest trying to deal with corporate and then ask for the GM zone manager's contact information. After that go to the papers. I suggest that you stay off of social media. The use of social media can be open to discovery and you can have exposure through this discovery that you may not wish to have. These are you first free steps.

From there, seek out an attorney. It may cost $1,000-1,500 to engage an attorney. What is your deductible? What will be the costs of you paying $1,000 or more per year for your car insurance for at least 3 years.

If it proceeds to court, you may well be entitled to be reimbursed for you legal fees.
