Wheels and tires stolen while at the Don Hewlett Chevrolet Central Texas

Took my Camaro to the dealer which will remain nameless depending how this is resolved. They had to order a part so I had to leave the car overnight. Someone broke into the dealer that night and stole my wheels and tires, jacked the car up by the rocker panels and left the car on the ground which damaged the fenders.

The owner contacted me and said he would need to put some wheels on it and get it to the body shop to assess the damage. He contacted me the following day and said he had an estimate ready and wanted me to be out of pocket the least as possible. He went on to say I have a signed waiver that says I'm not responsible for loss of damage to your vehicle. I was pissed, I asked how any of this is my fault and why should I use my insurance and have to pay my deductible. I told him how about being a man and making it right but I don't think that's going to happen.

My insurance sent an adjuster over and he was basically told they aren't paying anything. I contacted the owner and the best he'd do is pay my deductible if I let their body shop do the repairs and his parts department order the parts. I think that's a bunch of crap and don't want them to make a dime off my car.

Im kind of screwed since I don't have any wheels or tires I can't get my car out of there. If anyone in the Austin TX area has some take offs I can rent just to get my car out of there I'm willing to pay a fair price and will only be using them for 10 miles at the most.

Hey I had this happen to me years ago. They tried the same thing to me, but I pointed out to them that the lot was not secured, their fenceing was not maintained and it was easy to walk into the lot after hours. I talked to the owner, and said it's your responsibility to maintain a secure lot and you didn't. My next point was I should talk to the local paper about this issue. He agreed to replace and fix any damage that was done.

Hope this helps you.

My insurance adjuster was dumbfounded that they wouldn't step up and make it right. My best friend is in charge of the neighboring city vehicles and uses them for parts and service for around 100 vehicles. He said he's taking all the city's business elsewhere so they'll lose a lot more than the cost to repair my car.

Inside job?

Seems like an awfully convienent way to make a routine service very profitable.

I think that would be a great one for you local news stations. I know here the news stations love that kind of stuff, seems the problem always get taken care of.
I would walk the fence and see if it's secure. Blackbeast has a great point. I'm sure it will be a small enough amount for small claims court. I know small claims is under 10K here. If the fence isn't secure take it to small claims and make sure and request a jury. I think the juries response would be about the same as the responses here.
Did they tell you that you were signing a release of liability?

I do have to ask, did you sign a waiver?

I'm not condoning any lack of responsibility on the part of the dealership but if you did sign a waiver you just might be SOL.

Anyone remember where all of those other tires and wheels were ripped off recently? Thought it was also in Texas.

Something I did whenever communicating with the dealer about replacing my car is record all conversations. I have a recorder to record live conversations and phone conversations. You can't record if he calls you. When you call him you'll go through a recording that advises that the conversation could be recorded. No guarantees you'll get anything useful, but if it goes to small claims court his attitude, etc. may play in your favor.

Yes it was in Texas, but they stole them off of 20+ cars. Sounds more like this was just one car...or was it more OP?

Are you kidding me? Your car was in THEIR posession when this happened and they seriously expect you to pay ANYTHING? Um, **** NO, if their security was what it should be, considering where it is, this would not have happened. I would tell them, quite clearly, where they could shove that load of BS.
