Find a different dealer. ASAP. Seriously. That is unacceptable.

We have had a few people
Bring cars into work with Smugde marks and it turns out it is kids hand marks with sunscreen on them, Machine buff is the only
Thing that would get it off or a clay bar

It looks like a big smudge. Dealer is going to try clay bar first but we both are skeptical if that will work. I am afraid it is probably under the clear coat. He looked at it from a lot of angles and concludes it was most likely caught by the factory and they "attempted" to fix it and obviously did not succeed and let the car go anyways. I took delivery at night and did not immediately see this and it actually took me by surprise when it caught my eye one day. I immediately tried to wash it off and quickly realized this was not something that was going to come off. So it goes in Tuesday for them to try the clay bar. We will see what comes of this.
Looks like a line worker hit it with the mini sander to remove a dust nib in the paint and didn't finish the paint down properly.

That spot would take me five minutes to correct. (I do this for a living)

Find a reputable paint correction detailer in your area, I would not let a body shop touch it.

Here is an example on a new at the time Aston Martin DBS Carbon Black Edition. This is how a $300K car comes from the factory.

They are fully wet sanded to remove all of the peel and texture, but the guys on the finishing line are not the most skilled.

This is a 50/50 after compounding under a Fenix LED light.

This car took 30 hours to correct as the entire car was in this condition.

Another 50/50 shot of the hood after compounding. Clarity is being restored.

The finished product.
