You definetly cannot get a cititation from a witness saying you looked like you were going over the speed limit. The officer has to see the crime personally. In CA, police in the investigation of a crash, can issue a citation if the officer has reasonable cause to believe the driver involved in the crash committed a traffic violation - even if the violation was not committed in their presence.



If a crash report was prepared, that is arguably the same as issuing a citation for committing a traffic violation and if both were done, I tend to see that as a bit of a d*ck move.


You can always dispute the citation in court. The burden of proof is on the officer together with any other information - testimonial, evidence, witness statements, real or the combination. Who knows, maybe the officer will be on vacation / no-show and the citation gets dismissed.


The other question, what did your insurance company conclude?

I just searched and it does seem it is tied into the airbag(s) deploying. Which I would assume they did with a side impact.

A person familiar with these said that manufacturers or insurance companies don't usually mess with them because the tool to use them can cost up to $25k! Ridiculous.

Your car has a black box called an EDR. It's an Event Data Recorder. It retains the telemetry data for the 10-15 seconds before and after the deployment of your airbags. It captures things like speed, yaw rate, brake pedal pressure, ABS activated, TCS activated, seatbelts on, etc. The data can only be extracted under court order, for your protection. Otherwise, insurance companies, law enforcement, and ambulance chasers would be having a field day with the data.

By law, the manufacturer has to tell you this is in your vehicle. It is in our owner's manual on page 368.
