Good ending to a sad story of my car being totaled

Recently, as some of you may know, I was in a pretty bad accident where my 2016 Camaro 2SS got totaled. If you read my thread where I was trying to figure out how much I may get for my car you might have read that I was found at fault for the accident by the police. When I first made the claim to my insurance, they told me not to worry and just because the police found me at fault they would still dispute the claim and take my side of the story. Well about two weeks later I received a phone call from my insurance adjustor explaining that due to the witnesses and the police report they would accept liability for the accident and not dispute it. Not only was I pissed that they weren't going to dispute it after I told them I was sure I was not at fault but I was also stressed because they told me that depending on the other party's medical bills our policy might not cover it which would family's house was at jeopardy. Up until now I thought I was just screwed and would either have to sell my house or be in a lot of debt.


HERE COMES THE GOOD NEWS, I had asked a few people to help me out and get that footage from the bus and now, a month later, a CD with all the footage finally came in the mail. The footage is 18 minutes long and clearly shows the other driver running the red light but due to the way the program that the video is on works I can only save 10 second clips at a time so heres the footage that saved me: https://drive.google.com/file/d/0B3l...dtMEN1NzA/view

To add to the good news, I was able to buy another Camaro with more options, and its a manual instead of an A8, for almost 2K less than what I was paid out for the totaled Camaro even after all fees and taxes and that car is being delivered tomorrow.

Great news. Its absolutely horrible when you know you did the right thing and people try to screw you anyway. Nice to see a not so unpleasant ending to this one.

It also reminds me that I have a dashcam in a box that needs fitting!

Exactly! Whats almost as bad was knowing that the other driver knowingly lied and said I ran the red while they had a green and almost got away with it.

Im with you, before any mods I'm getting a dash cam myself.

Glad that worked out for you, judging by how quickly the light turned green (about 1-2 seconds after impact) it was damn close to the both of you running the red light. The best possible outcome you weren't seriously hurt, and 2. you got into a newer and better car congrats

Yup, was very close. In the statement I gave to insurance and the police I told them the light turned yellow as soon as I hit the crosswalk to enter the intersection so this video should confirm that.

The car I got wasn't new though :( has about 6k more miles than my first one but I'm not complaining.

Has the insurance been settled? If not I hope they don't get into a "timing" issue. That video could prove both ran Red, but from what I have heard here, you have nothing to lose because it for sure proves the other car did in fact run the red light, proving you did (if you even did) would take a little more effort, and since the other driver claimed they did not run the Red, this proves that they for sure did.

Even if they would go into that argument then, unless there is other proof, the only thing we see here, for a fact, is that the other car ran the red light and it was red for more than just a second.

Yes, him running or not running a red light can be disputed, but the other driver cannot, so I don't see an issue here.

Nope not yet, just sent the video and the contents of the CD in a file to my adjustor a few hours ago. But I was kind of worried about that myself but I live just a few blocks from where this occurred so I've checked the timing of the lights multiple times. I initially thought once the light I went across turns red they both go red for a couple of seconds before hers would turn green but I found out it only does that when her light goes red so in my case as soon as that light turns red hers will turn green with no delay. So if their insurance does decide to dispute that I'm pretty sure they can send someone down to check that or I can even get it on video myself.

I agree, the for sure fact I that the other car ran the red light, it really is as simples as that, even the other Insurance provider can dispute that, the car had no doubt they ran the red.... probably was texting and never looked up

Glad you found some evidence to prove your statements. Hopefully everything goes your way with the video now available. Please do yourself a favor and buy a dash cam to go with the new car!
