reduced engine power cold start

I'm getting a code on cold start P16F3.
and the car goes into performance reduction mode.
It has done it a couple times in the past but the last time it was tuned (on E85) it does it on every cold start.
I am thinking the ECM needs updated, but not 100% sure this will fix it.
has anyone else ran into this issue?
Lots of mods on the car and have been done for almost 20k miles the latest parts were pray IM and TB and a DSX E-85 kit and re-tune.
once I clear the code it runs awesome but every morning it throws the code and goes into limp mode.
