***WARNING TO ALL SELLERS YOU ARE NOT PROTECTED *** Read below its long but I believe informative Let me tell you something about PayPal I have been using the service since 1999, I ran into my 1st issue in 2008 when my account was hacked and $1200 was taken out of my account to buy a camera over in Europe (I live in Florida so why buy a camera in Europe and pay 3 times the amount as what it really costs). PayPal at the time had a lot of issues with fraud at the time and they said they would take care of it (I never had ever purchased anything in Europe and the time of day it was purchased is not I time I was logged into EBay to make the purchase) well PayPal was too slow in responding so my bank took care of the issue and refunded my money. My next issue was December 2012 I sold a customer a nice custom car show display stand for his 2009 Corvette the cost was $410 shipped, the customer received the stand sent me a few emails with photos telling me the stand arrived and he loved it and used it. The customer then filed a claim with American Express saying the stand was not what he ordered and I refused to refund him his money. Now remember I have proof the customer sent emails saying he loved the stand and he sent me photos of the stand with his car at a car show. One day I log onto PayPal and I notice $400+ removed from my account I called PayPal to see what the deal was and they informed me that the customer filed a dispute NOT with PayPal but with his credit card company. I did my due diligence and filled the appropriate paperwork with PayPal including sending them the emails and photos. I mean I have all the proof in the world he used the stand and even said he loved it with the photo he sent. You would think this is a slam dunk well think again. PayPal told me since the customer filed a dispute with his credit card company there is nothing they can do for me even with my proof, my only recourse was small claims court. Now seeing that this scumbag lives 45 min away I took it upon myself to hit up a local cruise-in one Saturday (I took all of the documentation with me) and what do I see a black corvette with my car show stand. Needless to say after 15 minutes of embarrassing him with his local Corvette club the guy went to the local ATM and handed me the cash. Case closed I was happy to get my money but still pissed at PayPal. Again my business on average I have around 10+ sales a month and no issues since opening in January 2008. Fast forward to February 2014 I yet again log into my PayPal account and this time I am blown away $4217.35 my PayPal account is in the negative I was like WTF I call up PayPal seems a customer who purchased car show stands from me said they sent them back to us because they were not going to use them. Now here is the real kicker the stands were purchased in early Sept 2013 they needed a rush order (10 stands powder coated) for the Barrett Jackson show in Las Vegas 9/26-28, 2013. We rushed to get the customer the order not only did he receive them but he used them. We happened to see 7 of the 10 stands on display with his vehicles at BJ on TV. I figure how cool is that our stands on live TV I recorded it plus took photos for our web site. Well this douchebag files a claim he ordered stands never used them and sent them back funny he never contacted us, and never sent anything back by the way we have several disclaimers on our site that no returns on custom ordered stands all sales final. So I gather up my information send it all to PayPal again it should be a slam dunk I have images from TV and emails he needed them for BJ. Well to my surprise PayPal said unfortunately they cannot cover me (under Seller protection) due to the fact the customer filed a dispute with his credit card company and not PayPal. Per PayPal once a customer files a claim with his or her credit card company the sellers are no longer protected under PayPal’s policy. No matter how much evidence you have you are NOT covered. My only recourse is take the customer to court and PayPal said they will provide any help they can. But I am on my own to hire an attorney, file papers out of state , take time off of work, travel to Colorado for court if needed, and in the end the money I might recover it will end up costing me more money than what I lost. So what did I do I have stopped accepting PayPal for all sales over $100 I require the customer to pay by company check or money order. Unless they are a repeat customer then I will accept PayPal. Has it hurt my business Yes but I cannot afford to take a $4xxx loss when PayPal offers me the sell zero protection once a buyer files a dispute with his or her credit card company. I looked at Square, and Google store same thing once a buyers disputes a charge via his or her cc company those services no longer protect the seller.

When using paypal. ALWAYS put a description of what you are buying!
I sold my 4.11 posi center section from my old mustang last year. Will all the e-mail's and text from the guy I felt something was strange..... Well he finally commit's to buy it, sends me the money. I send the CS. About a month later, very very long story short. He claims that I sent him a bucket of sand. (I had sent the CS in a 5 gallon bucket because it fit perfect). He demands his money back via paypal. I figured that I'm screwed! He sent the money as a "gift" with no explanation of what the money was for. So I, the seller, was covered. I firmly believe that this guy knew or thought he knew how to screw me over. But because he sent the money as he did, I was protected. I'm not sure that I'd ever sell anything that expensive via paypal again especially if the item needed to be shipped. |

So I got this email yesterday from the seller. Can I take ut the claim and if he doesn't come through re-initiate it?

So I called paypal and was told if I removed my claim it would get closed and I would not be able to reopen it. At this point I will just have to wait to get my headlight and remove the claim. I paid on Feb 4 and received 1 headlight on Feb 10. So far I haven't received the second headlight, its been 15 days since I paid so I don't think I am being unreasonable in not closing the claim yet, until after I receive the headlight.

FWIW paypal will always side with the credit card company. Paypal is basically run by CC companies because that is usually the main source of funding of these transactions. If paypal fought these transactions, CC companies would pull their relationship with paypal. Therefore paypal would end up losing money. so they pass on the losses to the seller.
