A good attorney will file for continuances, file for report on the radar gun, have you get your speedo calibrated all the way up to the speed you were charged with, pull your driving record and have it entered into evidence, pull your insurance history and have it entered into evidence, all if these things are in your favor. Then the chips still may not fall in your favor. But it is the only shot you have.

this is very bad advice.. 25+ over the limit is a misdemeanor in California, chances of the Judge lowering the fine is slim to none.

What will happen here because of being triple digits is the D.A. in your county WILL get the case, and you WILL be prosecuted, this is not a normal traffic court situation.

If you can get the D.A. to drop it to under triple digits (and chances are you will need an attorney for that) AND get it under 25+ over, then traffic school is an option.

Anything 25+ over and traffic school is not an option, anything triple digit is a misdemeanor traffic offense.

Take it from someone who has been thru it, the laws here have gotten HARDER since 1993, not easier..

These are State Vehicle Codes, not county laws, so it will go to the Superior Court, not to traffic court, that is why you have a mandatory appearance.

I also suggest you get a ride to the court, because the Judge can remand you to custody and impound your vehicle on the spot if he so chooses.

You need an attorney. This is a serious matter.
I just spoke with a friend who is an attorney out in CA, and she said you'd better get an attorney.....you'll be lucky to keep your license after you go to court....she said maybe 30 days or 3 month suspension and a size able fine. She's in real estate law, but knows enough that I'd take her word and seek some counsel ASAP.

Just pull this off of DMV.Org

Serious Traffic Violations
Some of these include reckless driving, following too closely, driving 15 mph or more above the posted speed limit, improper lane change and driving a commercial vehicle without the proper class CDL and/or endorsement. A conviction of any of these violations will result in the loss of driving privileges for:
  • 60 days for a second conviction of any of these offenses within a three-year period
  • 120 days for a third or subsequent conviction of any of these offenses within a three-year period

I've been up to 101+ in my car (closed track), really it's not easy to tell as these cars ride smooth.

the key word there is CONVICTION..

he hasn't been convicted, and he can avoid it with a specialized traffic ticket attorney..

chances are if he gets one, it will be reduced to excessive speed and violation of the basic speed law (driving too fast for conditions), with a fine and/or community service and traffic school.

but if he tries to play it on his own, yes he will suffer. the Judge will slap him down, then the DMV will hold a hearing and slap him down again.

Minn. Law is you got over 100 and you lose your DL for 6mts Automatic. Then comes the careless driving, then the speeding fine, and then whatever the judge feels is a fair punishment. and thats with a clean driving record. :(

To the op, sorry about the ticket dude. You didnt notice the speed, guess best way it to plead guilty to a lesser charge, say that you didnt realize you were speeding and that you were not intentionally trying to speed

Just be glad you dont have a CDL license. 15 MPH over the speed limit is grounds for immediate license revocation and youre vehicle being towed.
