I have the darkest available tint but the lights still shine through. Totally legal as far as I know. There are a lot of threads about the dark tail lights. A lot of photos have been posted with tint and the lights shining through.
Search 'dark taillights' and get ready to do some reading.

I just ordered the gunsmoke to match the headlight tint I got in gunsmoke also. Doing the side markers and rear reflectors in charcoal. Black bowties. I ordered the GM dark tail lights also.

so far ive spent 3 grand on the car and I don't pick it up till this weekend lmao
