How safe is the 265/30/22 tire?

This morning I went into Discount Tire trying to get a screw taking out and patched. The manager stated that he couldn't do it because the tire isn't safe to be on the car. My pirelli 265/30/22 load index is 97 and it needs to be at least an 100. I been having this wheel & tire package for 7 months and never knew this. I know quite a few of yall are running this tire, have any of y'all experienced failure? Should I be worried?
