From the Texas lemon law, it's 2+ times for a serious safety issue (steering counts for this IMO):
"The Serious Safety Hazard Test A serious safety hazard is a life-threatening malfunction that substantially impedes your ability to control or operate the vehicle normally, or that creates a substantial risk of fire or explosion. You pass this test if you have taken your vehicle to the dealership two or more times for the repair of a serious safety hazard during first two years or 24,000 miles, whichever comes first, and the problem continues to exist." Also seems that the 30+ day test is also passed... that's a lemon in Texas, no questions. |

So I just got off the phone with an attorney. The reason I'm considering this is because the BBB and Chevrolet are not willing to replace even though by law I've already met the number of necessary attempts.
Per the Lawyer, he says he's been working on GM cases for over 20 years and I'm likely not going to get a replacement vehicle from them willingly...he will represent me no charge (Chevrolet pays the court fees upon winning or if we dont win I don't pay anything.) but in order to get a replacement vehicle it would likely have to be by judge ruling...now get this...he says the total process can take over a year! ... He said what will likely happen is Chevrolet will offer me a settlement (money) for the downtime and inconveniences long before that happens. I went ahead and proceeded for the replacement anyway... Opinions? Autonation Chevrolet -- After this issue is resolved I dont see myself returning... |

I have all my paper work ready to go but this has just been a huge hassle. love the car to death but man do I the purchase haha |

Ugh, more bad news.
My car was supposed to be done today for the replacement of the Steering Torque Sensor.. Guess what happened.. Chevrolet Customer Service Business Resource Center sent another GM tech requiring them to make the repair (instead of the dealership) and test the car before releasing. No ETA as to when I will get my car back either. I have a lemon law attorney working on that but he highly doubts Chevy will take it back. I am half suspicious that he doesnt want Chevy to take it back on the account that if I settle for money he will get paid. -- I am contacting the Georgia Consumer Protection unit for Lemon Law. I'm done with this car. |

Spoke to the Georgia Consumer Protection Agency Lemon Law division.
In short they say I qualify for the replacement vehicle in just down time alone and nothing else is necessary. They are sending me a form to fill out for the repurchase or replacement of my vehicle to send to GM and if GM doesn't comply then they will step in on my behalf. I will miss my 2SS but this is more trouble than I can deal with. Now here's the million dollar question...what should I opt for, repurchase and just focus on my 99 Z28? or replacement and hope I never have anymore issues? The downfall with the repurchase is - they will likely add depreciation on there and I may still have a car loan without the car. The downfall with replacement is - This will be my 3rd 6th Gen in less than 3 years with the previous two replaced due to problems too complicated for GM to resolve. |
