So sorry and glad you both are generally OK. Distracted driving is a dangerous societal menace and generally agree about too much litigation, but you have to sue to recover fair value and be compensated for your time, injuries and loss of property. I am pretty sure his insurance company will not make a fair offer for all of these things to you.

Sorry to hear and I'm glad neither of you didn't get seriously hurt from this.
I too was a victim of a driver that was texting and they totaled my 06 GTO back in 2011. If it wasn't for that, I know I would still have the car. It was great. I would have sued but since we both were military, there is a law forbidding a military member being able to another military member in a situation like that. Just be glad it didn't turn out any worse than it could have but I would still sue them. You're not getting the money from the driver but from the insurance company. So don't feel bad because it'll be the insurance company you'll be going after. |

Gods way is to forgive. What comes around goes around. Most of the guys here that push Sueing from California or other blue states?
