Damage advice
So I took
It to the clear bra today first day I've driven it because of rain , he pointed out three small dents on trunk and glass has a huge scratch in it . The car left th dealer very dirty and you wouldntt of seen the damage because of the dirt covering up - I bought in Virginia shipped out of state to Georgia , the dealer blames the shipper and shipper the dealer . What should I do ? ? My detailer says they might be able to pop dents and polish but nothing with the back window late scratch |

I have a feeling if you didn't note down those dents when you took the delivery, expense to fix them will fall on you. I had mine shipped from Atlanta to Boston area, I asked dealer to only use bonded carrier as part of sale agreement. Dealer did the walk around the car with the carrier before handing them the car and I did the same before taking the delivery. Once those two docs are signed off clean then shipping part is off the hook.

PDR the dents, works good and cheap. A good PDR guy will make it perfect as long as there's no paint damage.
Hard to tell in the pics, where exactly are those scratches? Just outside the glass? Some may polish out with glass polish and an orbital. I wouldn't replace the glass. Half ass shippers strike again. I have shipped a few cars, I only use Reliable. They are over the top careful. |

Polish at this point it's prob not worth dealing with the dealer |

My car has a scratch in the front windshield near the top on the right side about 7" long, and I discovered that the left rear valiance bracket is broken.
Scratch in the glass is not that noticeable, and my dealer is replacing the bracket. It was either over tightened at the factory, or the transporter moron caught it on the truck ramp. Hope yours works out for you ! DW |

You are likely not going to be able to collect back since you didn't notice the items when you took delivery.
However, there is a little know piece of legislation called the Carmack Amendment that actually shifts the burden of proof from the receiver to the shipper when it comes to proving damages. This is the complete opposite from what we are used to in litigation. The motor carrier actually has the burden of proof to prove that they DIDN'T cause the damage rather than the receiver and shipper having the burden of proof to prove that the motor carrier did cause the damage. This law keeps motor carriers from saying "it was like that before I got it for delivery" and just telling receivers to go away and sue the shipper. It's worth at least researching. However, the damages are so small that filing a Carmack Amendment lawsuit (which would likely be in federal court) would not be worth the costs. So in the end, I would just learn from this. But at least now anyone reading this can learn something about interstate motor carrier shipping laws |

She got clear bra today and ceramic coating next week will take the dents out and polish!!!!
