The hardest bit about the small claims court approach, I think, would be getting an "expert" to show up on your behalf. Paying a notary to show up at a rival tire shop so you can get a notarized affidavit from your "expert" is probably easier. The problem with courts is your day gets eaten up by delays and no one is gonna commit to that for you. Insurance, if they cover you, will probably want to cheap out and go for repair. |

I posted a negative Google review of the shop that ruined my wheels over the weekend. I guess they pay someone to monitor reviews and I received this response:
"We apologize. our crews priority is your complete satisfaction! We truly apologize that you were not treated properly. When you can, please contact our consumer solutions department at 914-984-2500 option #2 and we would appreciate the opportunity to speak with you." So I called them yesterday. I was told they would reach out the the regional manager that offered to repair the wheels. We'll see what happens but I'm not getting my hopes up. I also did some research on Mavis Discount Tire, which I should have done before letting them service the car. It seems that they have been sued numerous times. In one case they were supposed to perform a brake job on a large SUV based limo. I don't know.
Chains like mavis and pep boys have late hours during the week and are open on weekends (at least around here), which actually helps those of us with jobs. I have had both good and bad experiences sending my kids there, since dad isn't nearby to fix their cars. And they are all about convenience, so I tell them that's the trade-off. |

Yeah, I so should have done my research. In that regard, this situation is partially my fault. Unfortunately we were in a cold snap of 20 deg. F temps for over a week. My wife was getting pissed that I was taking her car to work while we had a brand new car sitting in the garage. Her coworker who lives nearby was taking her to work and she was afraid it was pissing him off. I had to move fast and get the new tires. I learned my lesson. Never again.

I agree that the 'right thing' for them to do it replace the wheels. Unfortunately in todays overly litigious society, and crushing weight of bean-counters, it becomes what's the cheapest route to make a problem go away.
The upside is, small claims court should be an easy win, and a good wheel repair shop can work magic. My experience, in a construction zone, a lady decided she was going to occupy the lane me and my 6 months old C7 2LT M7 was in, and I had hit the binders and swerve hard to avoid an accident, doing so I drove over, at about 40MPH, 2 raised access covers (the smaller ones). TPMS immediate went off and both passenger side rims had thumb sized divots in them. Literally. I took them to the shop recommended by our local Audi dealer (Wife drives an Audi, 1+1=... ) and they said they could fix them. 4-5 days later I picked up the wheels, took them out into the bright sunshine (summer day) and could not find the repair. On a gloss black forged wheel. I was amazed. Now I don't really worry too much about stuff like that.

I know it sucks and most likely I am as anal-retentive as you, but the shop will not give you brand new wheels if they did not damage the wheel structure or break the wheel per say during the install. If they offer to refinish them, then they have done their due diligence to correct the wrong. If this same situation would have occurred at the dealership, they would also rectify the issue by having the wheels refinished without you knowing. Nevertheless, the best place that you can have your wheels refinished would be Wheels America. They have several locations throughout the USA. I have used them multiple times to have my curbed wheels refinished with powder coating finish approach or by CNC machining the wheel if the damage permits it. Their work is lifetime warrantied.
