I'm in Canada, but....:

What happens if you have a car on order....it shows a build week (in a few weeks) but you change your mind....and want to get something off the lot (theirs or another lot). Do they keep the deposit? Are they allowed to cancel it at the factory? Is the contract binding (ie can they hound u for the car balance). Unlikely but I'd like to know before i go talk to them. Any advice is welcome.

This is going to depend on a couple things.

- Does the car actually get built? Plant is shut down at the moment....

- What did you sign with the dealer? If you have a written contract your answers will be in there. If you just have an oral contract it gets much dicier. Read all documents you have carefully and make sure you understand what was agreed to. If you are unsure how to interpret the documents, you might want to seek legal help.

I can't comment on how late in the game the dealer can cancel the order - someone else can chime in on that. Assuming it's too late I see the possible outcomes as follows:

1. The car does NOT get built in which case they did not deliver what was agreed to and should refund your money.

2. The car gets built but they agree to refund your deposit - maybe on the condition that they sell it in xxx days, or you apply the deposit to another car bought from them.

3. The car gets built and they demand contract performance (i.e. you either buy the car or lose the deposit)

If you are still buying from them you have more leverage for a win-win outcome.

I would NOT have the initial conversation with the salesperson or the sales manager. I would make an appointment to sit down with the General Manager and speak directly to them.

Remember to seek legal help right way if it looks like you need it.

Its only a 500$ deposit. I was afraid they would come after me for entire balance. I did sign a binding contract. It says im on the hook for balance but would they.

My goal was to cancel this order....and buy a better one ($15k more) sitting at a sister lot. I kinda cheaped out on original order...now I want to upgrade since I know a bit more and have a bit more money to use.
