First of all, I want to say thanks to everyone that has chimed in.
I hope to answer all of your questions straightforwardly and I hope I can answer each and every one of your questions, so bare with me as I did not know this would get so many replies!! I realize there is no "right" or "wrong" outcome in this scenario as it was clearly a clerical error and now both me and dealer need to resolve it. I am not one of those guys that takes advantage of people when I can, but at the same time I am not one to be taken advantage of. I'm in commercial real estate / development and I have made plenty of mistakes in my past, similarly to this situation when I've priced out a project wrong or made a typo on a contract. And guess what? Usually the customer or company we sign the contract with gets the benefit and we eat the costs. There's been other times that we get the advantage and have "extra cushion" on certain projects and deals. It all evens out. But if I make a mistake, my boss chews ME out, he does not go to the customer and ask them for the $difference$. It would be a disaster if we took that out on our customers and ruined relationships. My father is part owner of a Cadillac dealership in San Diego. I used to work in the parts / sales dept. when I was younger. I know dealerships are a dying breed and are not profitable as they once were. Every cent counts. We used to own over 15 brands. Now he is just down to 1. Cadillac. I even talked to the general manager at my father's dealership and he says don't sweat it; it's THEIR problem. Drive the car and enjoy it and sooner or later, they'll come to their senses they made a mistake, and there is no reason y'all can't be friends still. I even asked him for an employee code and he's like "I don't mess with that stuff; it's like a black market if you are not really a GM employee and it's not worth the risks associated with doing that if your not really a GM employee." So that's out of the question at this point. I look at it this way: I got lucky with a good price on a new ZL1. If they want it back, there are plenty of 17s on the lot and even more 18s on the way. As far as racking up miles: I'm just driving it normally. Has about 400 miles now. I've washed using the two bucket method and waxed the car. I am very anal about swirl marks and such, so if I do keep this car, it's perfect. At the same time, if I have to return it: It's just a car. I can find another one. I've taken very good care of it, though. As of today (Saturday) the down payment check I gave them has cleared and has been taken out of my account. On Friday the dealership wanted me to show up before 5pm to change the contract. I didn't show because I had to stay later at work and I did not call them because I was so worked up about the whole situation. They did not call me. We'll see what happens on Monday. Maybe they have already accepted the reality since they cashed my check? About the loan: This is the second new vehicle I've purchased and I've learned a lot from this process. There was a member on here that said IF the contract makes no mention of an employee discount that I didn't apply for it, then I don't owe them anything. This dealer intentionally made this contract somewhat vague and this time it bit them. They did not give me any loan information before I left the dealership. They just tried to get me to sign the contract and leave. It was late (almost 9pm) and it looked like to me they just wanted to get the hell out of there. I bought a brand new Jeep Rubicon in 2015 and they same thing happened to me then: the dealer called a few days later and said, we have a problem with the loan APR %, please come in a sign a slightly higher rate. I told them: thats not going to fly, and you are going to have a Jeep on your lot with slightly higher miles than a new Jeep. Give me my money back. Got a call a few days later and he said "We had the bank do us a favor". I kept the Jeep with my original deal. I know in the future now, I should have came with a bank note or cashier's check ready in hand to the dealer vs. going through the dealer. That was my plan, but I literally sold my Jeep the same day I picked up the ZL1 for $42,500 (that I had already owned outright) and the funds were clearing the bank still. I had the difference in my account (which is the down payment I gave the dealer). Anyways, here's some pics. My daughter doesn't know what to think! She loves it but is absolutely terrified of the sound when I start up the ZL1! |

IMHO, The salesman screwed up and then tried to throw you under the bus with his boss. His boss took the salesman at his word and called you a liar. If it were me I would be a lot more upset by being called a liar than anything else. You walked onto their lot with your wallet and paid what you thought was Supplier pricing for the car. For the dealer to realize they F'ed up and come after you for the difference only shows me what a shitty dealership they are. In a customer service industry you don't make a mistake and then tell the customer they misrepresented themselves when you realize your mistake. I wouldn't pay them another dime simply because they called me a liar, but that's me. Good luck on Monday, would love to hear what the final outcome is. Cute kiddo by the way, I've got two girls myself, a daughters smile is a powerful thing. |

Yeah, wow is right...
You used to work at a dealership, your dad is an owner of a dealership, you had this same scenario happen with your previous purchase of a Jeep.....and you put up a thread here asking for advice on what to do?...lol.... Have a nice day. |
