I've read opinions from a few people saying the lawsuit is baseless...sounds like the firm that's filing it is into filing frivolous suits just to see if they can make one stick.

Bosch provided VW with the initial software that recognized an emissions test was taking place, with a written warning that its use in saleable units was illegal.
I could be wrong, but I believe the use of emissions software is legal as long as it's disclosed to the EPA and the software doesn't actively attempt to recognize an emissions test is happening.

OK, somebody teach me about diesels...
Faking emissions... bad... I get that. What I don't get is why does Colorado have to specifically ban "rolling coal" (another thread on this page)? Wouldn't making your truck smoke like a mother****er pretty much mean it is violating every EPA regulation on the books and already be obviously illegal? What am I missing? |

They are banning it because people roll coal next to people walking on the sidewalk or open car windows.

But isn't altering your emissions equipment... which I am assuming is the only way to make a truck do that... already against federal law?

Could be wrong, but I think the manufacturer has to sell you a car which complies with emissions regulations. What you do with your car afterwards is your business, unless you live in a state with inspections.

No, it is illegal under federal law for an end user to modify the emissions controls. It's just highly unlikely that the EPA would come after a vehicle owner or even the shop that performed the work. They have certainly cracked down on certain manufacturers of tuning equipment and software, however (H&S Performance is an excellent example).
