I don't even know what I am being charged with, He never said anything about reckless driving. He seemed like he was trying to help me with the prayer of judgement, The funny thing is he said he owns the same car that have except he has Black rims. Maybe he is on this forum somewhere lol!!!

if its a wreckless charge it should state it on the ticket. My 116 was and could be charged with wreckless endangerment and I was just charged with wreckless driving (stated on the ticket)

If that does come up with reckless driving when you search it I can see why it would be a mandatory court date.

In GA, with reckless driving you have to go to court. No just going online and paying a fine.

if it's like here in VA, even though it's called speeding 19MPH or more over the speed limit, it's also reckless driving. in fact, driving over 80 mph is also treated as reckless even though some portions of the interstates have speed limits of 70mph. that means a 10-19 mph speeding would also constitute reckless driving. it's not that you weren't charged with speeding, it that the level of speeding you were charged with is considered reckless.


basically, here in VA there are three different speeding tickets. 1-9 mph over, 10-19 mph over, and 19+ mph over. the last is also classified as reckless driving. but your still charged with speeding.

but not to despair, a good lawyer will get it reduced for you. just don't go to court without one.

The wife and I have had a few and each time I found some lawyer, wrote him a check, and at some point in time later I got a receipt for my non-moving violation. Basically I paid a bit more ($100 or so) to ensure no points.

If it was just the fine it's no big deal but the insurance companies are the ones who can drain your wallet.

I am kind of surprised he didn't mark it down to 74 to give your a break - unless 20 over was the break??

I've actually been pretty lucky in that regard. haven't had a ticket in about 12 years now, but a couple times I was exceeding the speed limit by more that 20mph. in both instances the cop wrote a lower speed on the ticket so I'd not get the reckless headache. around here they no what a pain it is and only bend you over if you truly deserve. if your just going to fast they usually work with you some.

Rule #1, dont take legal advice from an Internet message board. There are lot of opinions and side line, wanna be lawyers out here.

Now, I have requested defered adjudication. Contact the clerk of the court you are required to apear in. In most cases you can just pay the fine and go on your way. Some courts offer a court costs an a defensive drivig course. Some will do pure defered adjudication. I will not go into the legal terms of this but you can do a quick google search and get all the information you need. But, to be helpful, what most jurisdictions require is a copy of your driving record and a letter showing stating you wish to plead no contest and request defered adjudication. They will want you to tell them that hav enot had a ticket in the last year or two and that you agree not to receive any tickets in the following year. (this is important, you ae telling the judge that if you are ticketed the defered adjudication goes away and you are willing to take the fies and everything else that comes with them if you are caught again).

LOL, After your Rule #1...you chimed in anyway...from TX and giving advice to someone in NC! That's cool though. With that being said, I too am not an expert however, (pause for effect) my Mom was stopped in NC for 17 over. In NC, it IS a manditory court appearance (unless you hire a good lawyer that can keep you from showing). She lived 5.5 hours from here so she called one of the lawyers to help out. It is not the price of the ticket it is the price of your insurance after the ticket...with her lawyer, her 17 over was dropped to "faulty equipment" she paid court cost and lawyer fee...somewhere between $400-500 total and nothing got reported to the insurance company.

Not an expert, but OP asked if anyone has had this to happen...I guess I can say I am in that boat as I listened to Mom worry until the court date had passed. Good luck OP!

Judges don't charge people, prosecutors do. Judges impose sentences and listen to arguments, instruct juries where applicable. Your description of what will happen is unconstitutional.

Since North Carolina is your state, why didn't you tell him what the max penalties are for his offense in the state of North Carolina. I know what they are in Indiana. Keep in mind all traffic penalties are uniform as dictated by NC state law.

Hire a lawyer. Many have flat rate fees that cost you the same as pleading guilty and paying the fine. You pay them and they go to court in your place. I got a ticket in Morrisville for 62 in a 45 with a mandatory court appearance. I wrote a check for $175. No court appearance, charges reduced to 10 over and best of all, no insurance points.

Forget the prayer for judgement BS. It's not worth it.

+1. I have known a few people that have done something like this but personally I think this is the type of thing that's best left to the professional. The successful lawyers know the who and how for each of the court houses they deal with. Worth the $ IMO.

Relax bud. I got pulled a few months back on 321 doing about 15 over i think. Just get a lawyer like everyone is saying. You should be getting all kinds of letters from lawyers in the mail this whole week.

Just go through them all and pick out one you can afford. These people are ex DAs or have connections that they use. Having a clean record as you did I wouldnt worry.

Its going to cost a little money which is really all they want. Id guess it will cost you 350 - 500 dollars but some of them will allow you to make payments.

For the record, I paid 230 and they dropped it completely. Lawyer claimed equipment malfunction.

Apparently, here in the state of NC you are allowed 1 of these every 3 years in EACH county if I understood them correctly.

So just wanted to help you relax a bit.

Yeah, the lawyer and the court split the money, nice system eh?

I'm not so sure people work as cheap anymore as the figures you speak of though. $175 sounds about like what the court wants for a 10 over ticket these days, and lawyers don't make deals for free.
