Been backed into before at a parking lot at the mall called the cops and all that did was give us a piece of paper to fill out and said they don't do police reports on private property... Luckily we had the same insurance company so got it fixed quick, but that does suck OP I feel your pain.

This happened to me when i was 16 yrs old... worst sht ever man. The private property thing. I was not at fault. She got away with murder.

It sucks, but I don't think you would have gotten much even from a police report. I can't tell in the photos if this is metallic black or just very dusty. If it's standard glass black, I don't see why you would need to get the bumper removed and repainted. It's something that can be touched up.

At least she told you what she did. The main thing is to stay calm and document it. If you had a recorded statement on video of her saying she hit the car, maybe that would have been a little more admissible as evidence. Yelling at her and making her cry sounds like it didn't help.

The private property argument is bs. While it's true that private parking lots aren't subject to laws of the road such as abiding stop signs, failure to yield, etc, when somebody hits your car, they hit your car. It's damage of your personal property. I don't see how it matters when and where it happens, unless you're literally entering a demolition derby of some kind and signed waivers. By that logic, I can go steal a car in any privately owned parking lot and can't be held accountable for my actions.

It's Burger King. They just don't want to be involved.

Than can be fixed very easily. Doesn't looked cracked. Our local paint and dent removal place could fix that for like $400 and you never know it was there

Police departments do not take vehicle accident reports on private property. It's been like that for years in most cities. Actually, most departments nowadays don't take any sort of vehicle accident reports unless there's an injury where medics are necessary for treatment.

The private property thing is not BS and it is the law pretty much everywhere. When I was in college a pizza delivery guy ripped the entire back bumper off of my Honda Prelude. He was hauling ass through the parking lot outside of Wal-mart when he hit me and a cop saw the whole thing go down. The cop did not fill out a police report, cite the guy for speeding, reckless driving, anything. Luckily, he had insurance and I knew where he worked.

Now with that being said, the property belongs to Burger King and if they did not have a sign anywhere in the parking lot saying that they aren't responsible for anything that happens in said parking lot, then if her insurance doesn't pay you can go after whoever owns the Burger King and their property insurance.

It's Mosaic Black Metallic. Will know more later today after the inspection by her insurance company. Hindsight is 20/20, and a recorded statement would have been the way to go, we agree. Not really worried, as it will get fixed one way or the other. Just wondering why she won't return the phone calls from her insurance company after she went to the trouble of telling us and giving us her information. Oh well, live and learn!

I guess it makes sense upon reflecting a little more. For example, part of avoiding accidents requires proper signage, design of traffic flow, etc. You can't really hold a private parking lot to those standards. I complained that folks in my apartment complex speed, blow stop signs, and go the wrong way in roundabouts, but the land lord's only response was none of it was enforceable.

This sucks-sorry to hear........ but sad that you made her cry. Not that you intended to do that. You may have converted her to a future "hit and drive off" person. These folks tend to become repeat offenders thru their driving lives.

I had a new g35 sedan some yrs ago that someone backed into in a strip mall p. lot. They took off and left me with $1,075 worth of repairs. Had a $1,000 deductible so I was stuck with the bill.

Have the exhaust checked. Had someone hit my car there, and a few days later the exhaust started rattling, cracked the weld on the muffler. Ended up getting it welded on my dime. Because when it happened, I thought it had no damage and I let the guy off.

It was sad that I made her cry and I really feel bad for that. That may be the reason she still hasn't contacted her insurance company, and I'm afraid the way I reacted has everything to do with that. Her insurance rep told us yesterday that they will go to great lengths to make contact with her. Estimate is approximately $1,000 to repair the damage.

Sorry for your bad luck with a drive-off - we had that happen twice with a new vehicle a few years ago, and that's not fun at all.
