Nope, mine was... but his has damage. We had a clean bill of health for a low speed rear end caused by an idiot.

It was not my fault. Was rear ended by a dump truck. I'm going to do my best to get a total replacement. If not I can sue for depreciation.

Damn man, so sorry about that. Hurts just to look at it.

I would really push to get it totaled... Even if they fix it up like new, it will always come up on a Carfax, so you are going to take a major hit on resale.

Indeed you can. i did this as well when my car was rear ended. the insurance company tried to fight me on it but i held my ground.

Just dont take NO for an answer.

No way they total it. I think it total BS for anybody to tell you that you can make an insurance company buy you a new one either. They wouldn't even consider it on a new car where the total repair was less than 85%. After it is repaired, you tell the adjuster you would like to file for diminished value. Each company does it different. Some use their own software to come up with a % of the value, like 1.5%. Others will let you go to the dealer and get some estimates, but they rarely go off them so don't get your hopes up on that either.
