I would suggest reading the insurance law for your state. When I had my little $9k door ding the law actually spelled out what the insurance company could do in regards to aftermarket parts and what rights I had with regard to diminished value. Most GM replacement parts are reasonably priced and my body shop was willing to work with me on using as much OEM as they could but some of the parts were salvaged and/or refurbished but that's the law where I live so I was stuck with it. If your state doesn't allow you to claim diminished value against the responsible party's insurance you should add it to your policy. And if you don't have any injuries you'll be hard pressed to even find a lawyer willing to press your case. You are pretty much at their mercy. Be polite, have all your information at hand before speaking with the claims agent. Commercial vehicles may be insured by out of state insurers so it pays to know the laws of your state. Just talking from experience. My car came back better than when the accident happened. That's not to say the whole experience isn't a big pain because it is. Such is life.
