The key should have never been barred from sale by CARB considering it is advertised as, and intended for, off-road use only. Did CARB ever step in with the GMPP stage 3 for the LSJ cobalts?

Nope, it's also off-road use only. The Trackey is a product sold by Ford Racing to be used on the track, not a factory preloaded, "mode" as you continually make it out to be. There is no, "both modes" from the factory. You have to purchase the trackey tune independently, the key simply activates the tune once you have purchased it and had it flashed onto the ecu.
Oh well, looks like they finally figured that out and the key will be available.
