This is also known in the legal community as "Breach of Contract" especially under the Magnuson-Moss Warranty Act for modified vehicles like ours.
I have a recorded phone call of GM refusing to honor the recall. The fact I don't have a warranty is irrelevant. And Magnuson-Moss Warranty Act specifically states it has to be proven in court that the modifications caused the defect.

My dealer called me right before they update TCM, they don’t wanna mess up my tune. I told them only ECM is tuned, They can update the TCM without any issues. They had no problem with that lol
