The hardest bit about the small claims court approach, I think, would be getting an "expert" to show up on your behalf. Paying a notary to show up at a rival tire shop so you can get a notarized affidavit from your "expert" is probably easier. The problem with courts is your day gets eaten up by delays and no one is gonna commit to that for you.
Insurance, if they cover you, will probably want to cheap out and go for repair.
