The only thing the police do is cite for improper operation or whatever. They have to either witness it directly, or be able to draw that conclusion upon arriving at the scene...

Here in NY, that is a hit and run, leaving the scene of an accident, and it IS criminal, not civil. Police will arrest you and you will be prosecuted, period. Check your facts.....
