The CA smog test only cares that at the time of the smog, the car has no tune and all drive cycles, etc. are ready. If the car was modded, put back to stock and sold as the OP is claiming, he wont have any issues with smog.
the dealer will deny warranty if the car has ever been tuned, whether put back to stock or not.
