In SCCA autocross competition, the answer to this is that any competitor may file a protest against a vehicle. A protest fee must accompany that. In a situation like this where the vehicle probably has to go to a dealership to have its module scanned to verify the calibration, I believe the protester must agree to pay for it and the protested party also puts up a bond to cover the costs if the car is in fact found to be illegal. IOW, whoever loses the protest has to pay all the costs associated with it. My guess is that in 99% of such cases, the person(s) driving the protested vehicle withdraws from the competition rather than pay for a service that they know will prove their car is illegal.
