GM hit with 2nd lawsuit over OnStar driver data being sold

Yeah just stop blasting GM on a GM fanboy/girl site. All OEMs are doing this. Google, Amazon and every app you have on your phone is doing this. But no one seems to care except for OnStar which is at least amusing.

This is a car site, so discussion about GM doing it is perfectly relevant. Other automotive OEMs allow you to simply opt out, right from your car…! And tell you point blank, in your car, when they are collecting data. Crazy concept right?!? They don’t auto re-subscribe you when you update your app either. Your argument is apples to oranges. Saying other OEMs do it is fine, but it’s HOW GM does it, and how hard they make it to actually opt out of it, that is wildly unacceptable.

Oh, if I don’t like Google, I can simply use Proton for mail. And instead of Amazon, I can buy from thousands of other websites using my VPN. But it’s a different story when you pay $50K+ for a car and can’t change how it communicates your data well after the car is yours.

Lets go to the Apple forum and complain about Camaros

Folks feel ripped off by insurance in the first place, and OnStar is being a snitch about what they really do behind the wheel. Can't blame the insurers, they're trying to get a more accurate picture of their risk by correlating the data. Problem is, consumers think their reckless habits should be secret from their insurer, and/or it's already baked in to the price they pay for insurance, and that was never really true...

Nobody cares that their ISP knows what kind of porn they look at or that their bank knows when, where, and what they buy with a card transaction (does your husband/wife know about that?). Or that their cell phone and smart TV listen in on conversations or that Alexa is basically a little snitch too, but they let her in the house. Or that apps on their phone are looking at their pictures and tracking their every movement....

But yea, let's have eleventy thousand threads raging about OnStar.

You don’t have to have reckless habits to score poorly on the smart driver app. Especially driving a ZL1. It was done without the owner’s knowledge or consent. It affected their insurance rates. I haven’t heard of ISP providers sending lists of naughty websites to anyone’s wife. I think there’s a difference here.

I have a good driving record. I drive responsibly. I haven’t had a speeding ticket since 2003.

GM still has no right to track every movement of my car and sell it -or even give it - to anyone.

Beyond the sharing of customers driving habits or whatever else is collected, I’m hoping that someone here can quantify what hard acceleration / braking means in GM’s software model? If you’re not accelerating briskly crossing or merging into traffic, you’re endangering not only yourself, but others (is this counted against a person?). When I was commuting to Boston, I’d brake relatively hard hundreds of times a week, regardless of the space I’d leave in front of me. That’s the nature of the beast. To compound this, I’d leave a space and jerks would slip in there and potentially have to brake even harder/ suddenly (again, what impact does this have?) how do insurance companies interpret the information provided? The whole concept of sharing that type data, prior to the customer fully understanding / viewing the potential financial impact, is 100% irresponsible and in bad faith on GM’s part. (As well as any other Auto manufacturer doing the same thing). Trying to separate themselves by selling to L- Nexis and then L- Nexis selling to insurance companies is the convenient “3rd party separation” anttempt to absolve themselves of known wrongdoing.

For me, I NEVER voluntarily enrolled in smart driver, told Onstar rep on the day of car purchase I WASN’T interested in even the most basic service, but nonetheless was still enrolled in the smart driver program. I tried unenrolling online and that didn’t stick, I tried calling GM and that didn’t work. I pulled the fuse, but now I have no ability to make or accept calls via blue tooth speaker. This isn’t a huge loss for me as I don’t typically have my phone on me while I drive. But, still it’s something I paid for that I don't feel I can use based on GMs bad faith.

People bring up porn sites, wives knowing, bank accounts etc or whatever else are living on a different planet. An attempt to change the narrative doesn’t change the narrative…This a a CAR site… we’re talking about major increases to / or inability to purchase CAR insurance. The last I heard, Porn Hub doesn’t impact an individuals ability to pay for / obtain car insurance, or for that matter, independently commute to distant employment. What if you owned a GM, you have a heavy foot, but you were an overall responsible driver and owned / drove a truck for a living? What if his wife, kid or friend was driving the car. What if the car was in for repairs and the techs took it for joy ride? Is it a dual use car road and track?

With insurance companies flying drones over peoples houses and cancelling home insurance with sometimes little to no cause, it looks like GM is a bit late in getting out ahead of the damages people and of course the lawyers are going to claim.

If you signed something or consented by agreeing to terms of service somewhere in an app or infotainment screen, or if by using a particular product or feature means you automatically opt-in to certain terms of service, then yes, actually, they do have that right.

And as we all know, a clean driving record and no tickets just means someone hasn't been caught yet.
