Civil court would probably rule in her favor regardless of seller type. If I were on a jury for a case like this would be I just can see any reason why the seller should not be liable for damages

And she also told me it had a clean blue Texas title.. But the guy they bought it from said he was sending in the mail. It all just seems so shady and idk if she can be helped now.

I don't think it's illegal for a private seller, damn who doesn't pop the hood or test drive a car when they buy it for 35,000 dollars. That's a riot man I'm sorry she was played like that

Did you try talking to the seller about your displeasure with the car.
Maybe he would correct the problem before you take legal action.

Her boyfriend thought it was a v8 but it's definitely not. I mean before we even popped the hood it wasn't very loud. It was a stock v6 exhaust so I already knew she was in trouble when I didn't hear the exhaust note sound deep.

The cash deal makes it a possible criminal issue as well if the if they mis represent the amount paid. But then again wouldn't the title have listed the make model..


The more I read this the more tempted I am to say this sounds like a fishy story leaning towards bs... But I'll give the OP the benefit of doubt

I haven't talked to anyone other than my friend who asked what she should do and I was lost for words. I wouldn't know what to do..

I said in above post that she said the guy was mailing the clean title and I already thought that was shady. Like I've said she's not the brightest.

I've already asked her boyfriend why he would pay for something in cash without a title. He said that he's done this before where the person will send the title over to them once they transfer it into their name or something. I know nothing about it because I've never bought from private seller. So I wanted to know if what was done was illegal? Or are they both just out of luck on this one.
