... stupid gates

My work has a huge gated parking lot, with a front and a back gate that opens with a security access card. The back gate has two arms that open and close to let you out... I was leaving work going out the back gate yesterday and half way through the gate, both arms come down and strike my car.... Damage and dents on driver side roof and passenger side rear quarter panel. Talked to building maintenance about it and the maintenance supervisor said he looked at the cameras and said "because I have a manual transmission, the car rolled back for a moment before I rolled through the gate, causing the system to believe I had already passed, so it closed the gate. They refuse to pay to get it fixed. I was already half way through the gosh damn gate before it started to come down.... but whatever, nothing I can do.

Yeah...they have insurance for a reason, and their insurance needs to pay to fix your car. "Because your car is a stick"...what a bull shit story. Go to management.

Lawyer will take your case for free gladly, and inform these dbags of the law. Have them give you in writing that they will not fix it or be liable. Their machine doesnt have a laser to protect vehicles from damage when their machine fails.

I think something a bit more colorful than stupid would have come out. No way I would let that go. They would not have a gate (or probably even a fence for that matter) if they did not square that away. The guy is trying to avoid a claim on your dime. What a POS.

I could be wrong, but I'm pretty sure the "maintenance supervisor" doesn't have the final word in company liability issues. Speak to his supervisor and then on up the chain until you speak with someone who actually can make financial liability decisions for the company. That is a crock and there is no doubt (in my mind) that the company should pay for repairs.

If that doesn't work, I would certainly not hesitate to threaten to sue for damages. I mean, what are we looking at here to fix your car... $1,000 tops? Good luck.

You need to have another conversation with them about it. They need to fix it. His excuse is just that, a BS excuse. Those gates operate from sensors (or loops) in the ground (you'll see a rectangle cut into the concrete, much like you see at intersections.) These loops pick up metal. Unless your car "rolled back" several feet than your vehicle movement would be completely irrelevant. The gate failed. It happens sometimes. This is why you'll see many parking facilities with foam padding on the bottom portion of their gate arms... Because they do fail.

I'd go get an estimate for repairs and have that with you when you speak to them. You need to speak with the property management company, not the maintenance person.

The problem as they cited was a problem with THEIR gate, not your car.

We have gates on one of our properties, we had to change out the loops as they were located in the wrong location and were doing the same thing, coming down on cars. The former building owner did pay the damages to the vehicles, put the gates up permanently, even though the loops were changed eventually. As it was caught on security, you should get a copy ASAP and present to management. No reason for them not to pay. I am a property manager, and the property owner would likely make good on this. Building ops don't make those types of calls or determinations.

Well, there is a problem with me going back to him. The email he sent me about the reason why he's not paying also went to my boss. My boss happens to personally know the supervisor, and the supervisor is great friends with all the executives on the board of where I work... so basically.. my boss told me not to press the issue and further and to pay for it myself/claim it on insurance. As much as I hate to do it that way, I actually love my job and don't want to burn bridges with executives. So I'm just going to bite the bullet.

Job may be nice but it's run by what sounds like shady lowlifes. Just my opinion from your statements above. They could be perfectly swell douches.

What he said. The facility manager has the last say. If not a good answer, keep moving up the ladder to the Corp. HQ.
